Trailer Warranty – Terms and Conditions
10-Year Limited Structural Warranty • Components Warranty • Care & Maintenance Guide
Please read these terms carefully. This warranty only applies if the conditions in section 4 are met, including registration within 30 days of purchase and annual servicing. Keep this document with your tax invoice.
1. ABOUT THIS WARRANTY
1.1 This limited warranty ("Warranty") is given by Bricon Engineering Group Limited trading as The Trailer Shop ("TTS", "we", "us", "our") to the original purchaser ("you", "your") of a new trailer manufactured by TTS and sold by TTS, or by a TTS-authorised dealer, in New Zealand ("Trailer").
1.2 This Warranty is a voluntary manufacturer's warranty. It is provided in addition to any rights you have under the Consumer Guarantees Act 1993 ("CGA") and the Fair Trading Act 1986. Section 9 explains how the CGA applies to consumers and section 8 explains how it applies to business purchasers.
1.3 In this Warranty: "Purchase Date" means the date shown on your TTS (or authorised dealer) tax invoice; "Structure" means the parts described in clause 2.1; "Components" means all other parts fitted to the Trailer, including those supplied by third-party manufacturers; and "GVM" means the maximum gross vehicle mass (Trailer tare weight plus load) shown on the Trailer's compliance/VIN plate or in our written specifications.
2. WHAT IS COVERED
Structural warranty – 10 years
2.1 Subject to these terms, we warrant that the main frame square hollow sections (SHS) and/or rectangular hollow sections (RHS) and the welded cross members of the Trailer (the "Structure") will be free from defects in materials and workmanship that cause the Structure to crack or bend under normal use within the GVM, for 10 years from the Purchase Date.
2.2 The structural warranty does not extend to parts attached or fitted to the Structure (for example wobble-roller and keel-roller supports, bracketry, guards, mudguards, cages, decks, lighting boards, toolboxes or accessories).
2.3 Commercial and hire use. If the Trailer is used for hire or rental, or for daily commercial or industrial work, the structural warranty period is limited to 12 months from the Purchase Date.
Components warranty – up to 5 years (supplier warranties)
2.4 Components made by other manufacturers are covered only by that manufacturer's or supplier's own warranty, for the period and on the terms set by them (currently up to 5 years, depending on the Component). We will pass on the benefit of those warranties to you and will assist with the claim, but the supplier's assessment and terms apply, and we are not liable for a Component claim that the supplier declines.
2.5 Indicative examples only (supplier terms change and may differ from this list):
- Trailparts – axles and bearings: 2 years (bearing failure caused by lack of greasing, water entry or immersion when hot is not covered)
- Jockey wheels and tyres: 1 year (manufacturing defects only – not punctures, impact damage or wear)
- LED lights: 5 years
- Trojan – couplings and winches: 1 year
- Rollers and bracketry: 1 year
Warranty period
2.6 All warranty periods start on the Purchase Date. A repair or replacement under this Warranty does not extend or restart the warranty period; repaired or replaced parts are covered only for the remainder of the original period.
3. WHAT IS NOT COVERED
3.1 This Warranty covers manufacturing defects only. It does not cover, and we are not liable under this Warranty for, any defect, failure, damage or cost caused by or relating to:
(a) Overloading – loading the Trailer beyond its GVM or axle rating, incorrect load distribution, or towing beyond the tow vehicle's rated capacity. (Remember to include the weight of any cage, spare wheel and accessories.)
(b) Misuse, abuse or accident – including collision, impact (kerbs, potholes, rocks, ramps), off-road or beach use, jack-knifing, dropping the drawbar, use for a purpose the Trailer was not designed for, or use by anyone other than in accordance with its specifications.
(c) Modifications or unauthorised repairs – any alteration, welding, drilling, added accessories or repair to the Trailer not approved by us in writing, or any work carried out without first following the claims procedure in section 5.
(d) Lack of maintenance – failure to follow the Care & Maintenance Guide in this document, failure to have the Trailer serviced at least every 12 months, failure to re-torque wheel nuts and U-bolts within the first 100 km (and after any wheel or spring work), or failure to stop using the Trailer once a fault became apparent.
(e) Normal wear and tear and wear items, including tyres and tubes, wheel bearings, seals and hubs, brake pads, shoes, linings, discs, drums, cables and actuators, light globes, lenses, wiring, plugs and sockets, springs, shackles and bushes, rollers (wobble, keel and bow), winch straps, cables and hooks, jockey wheels, safety chains, decals, paint and timber or plywood decking.
(f) Rust and corrosion of any kind, and any failure caused by rust or corrosion, including corrosion from salt water, sea spray, immersion, road salts, chemicals, fertiliser, grass clippings, acidic or alkaline loads, or failure to wash the Trailer with fresh water after use.
(g) Cosmetic deterioration of galvanising, paint or powder coating (such as white rust, dulling, staining, fading, scratches or chips).
(h) Water entry into bearings, hubs, brakes or electrical components, including immersing hot hubs or brakes, or immersing the 7-pin plug or wiring.
(i) Incorrect set-up or towing – including incorrect hull support, roller or bunk adjustment, or tow-ball download, unless the set-up was carried out by TTS; incorrect tyre pressures; the tow vehicle, towbar, tow ball, hitch or tow-vehicle wiring.
(j) Damage to other property – including any boat, vessel, load, contents, tow vehicle or third-party property.
(k) Events outside our control – including fire, flood, storm, theft, vandalism or acts of nature.
(l) Trailers bought second-hand, from a private seller, at auction, ex-hire or ex-demonstration (unless sold to you by TTS with written warranty), or Trailers not paid for in full.
(m) Components or accessories not supplied or fitted by TTS.
3.2 Where a defect is caused partly by one of the matters in clause 3.1, we may decline the claim or contribute only to the part of the repair we determine is caused by a manufacturing defect.
4. CONDITIONS OF THIS WARRANTY
4.1 This Warranty only applies if all of the following conditions are met:
(a) The Trailer was bought new from TTS or a TTS-authorised dealer, and has been paid for in full.
(b) The Trailer has been registered with us within 30 days of the Purchase Date by returning the completed and signed Registration & Acknowledgement Form (section 11) or completing our online warranty registration.
(c) You are the original purchaser. This Warranty is personal to you and is not transferable to any later owner.
(d) You keep and can produce the original tax invoice or receipt (proof of purchase and Purchase Date).
(e) The Trailer has been serviced at least every 12 months by TTS (or, if you live outside Auckland, by a reputable trailer service provider), and you keep dated service invoices or records showing the work done. We may ask for these records before assessing any claim.
(f) The Trailer has been used within its GVM and specifications and maintained in line with the Care & Maintenance Guide.
(g) You notify us in writing within 30 days of the defect becoming apparent to you (or of when it should reasonably have become apparent), and in any case before the warranty period ends.
(h) You stop using the Trailer as soon as a defect becomes apparent if continued use could cause further damage or be unsafe. Damage caused by continued use is not covered.
5. HOW TO MAKE A WARRANTY CLAIM
5.1 Step 1 – Contact us first. Before any repair work is done, email info@thetrailershop.co.nz (or phone (09) 444 5571 and follow up in writing) with: your name and contact details; your invoice number and Purchase Date; the Trailer's VIN/chassis number and registration plate; a description of the problem and when you first noticed it; clear photos or video of the defect; your service records; and details of how the Trailer was being used and loaded.
5.2 Step 2 – Inspection at our premises. Unless we agree otherwise in writing, you must deliver the Trailer to our workshop at Unit 5/95 Ellice Road, Wairau Valley, Auckland for inspection before any work is done. All transport, towing, freight, travel and associated costs to and from our premises (or a dealer's premises) are at your cost.
5.3 Step 3 – Repairs elsewhere need prior written approval. If we agree that the work may be done by another repairer (for example, if you are outside Auckland), a written repair quote must be sent to us and approved in writing before any work starts. We will issue an Order Number on approval. We will only pay up to the approved amount, and repair invoices without a TTS Order Number will not be accepted. Work carried out without consulting us first is not covered.
5.4 Step 4 – Our decision and remedy. We will inspect the Trailer and decide whether the defect is covered. If it is, we will, at our sole discretion, either repair the defective part or replace it (using new or reconditioned parts of equivalent quality), and cover the reasonable cost of fitting that part at our premises. Any part we replace becomes our property.
5.5 Step 5 – If the claim is not covered. If we find that the problem is not covered by this Warranty, we may charge a reasonable inspection and assessment fee at our standard workshop rates (we will tell you the fee before inspecting), and any repairs you ask us to do will be quoted and charged as normal work. This does not affect any rights you have under the CGA.
5.6 Step 6 – Collection. You must collect the Trailer within 7 days of us telling you it is ready. We may charge reasonable storage fees after that time.
6. LIMITS ON OUR RESPONSIBILITY
6.1 To the maximum extent permitted by law, our only obligation under this Warranty is to repair or replace (at our sole discretion) the defective part and to cover the reasonable cost of fitting it at our premises. This Warranty does not cover labour or materials for any other service or maintenance, or any freight or "return to base" costs.
6.2 To the maximum extent permitted by law, we are not liable under this Warranty for any indirect or consequential loss, including loss of use of the Trailer, loss of time, inconvenience, hire of a replacement trailer or vehicle, travel or accommodation costs, loss of income, profits or business, or damage to any boat, load, tow vehicle or other property.
6.3 To the maximum extent permitted by law, our total liability under this Warranty for any claim is limited to the cost of repairing or replacing the defective part.
6.4 We may improve or change the design or specifications of our trailers at any time without any obligation to modify trailers previously manufactured.
6.5 No dealer, agent or employee is authorised to extend or vary this Warranty unless the change is in writing and signed by a director of TTS.
6.6 Nothing in this section 6 limits any right a consumer has under the CGA (see section 9).
7. YOUR RESPONSIBILITIES AS OWNER
7.1 You are responsible for: keeping the Trailer's Warrant of Fitness (WoF) and registration current; checking and maintaining the Trailer as set out in the Care & Maintenance Guide; complying with the GVM and the tow vehicle's towing limits; securing loads correctly; and keeping your invoice and service records safe.
8. BUSINESS PURCHASES – CGA DOES NOT APPLY
8.1 If you acquire the Trailer in trade (that is, for the purposes of a business), you and TTS agree, as permitted by section 43(2) of the Consumer Guarantees Act 1993, that the provisions of the CGA do not apply to the supply of the Trailer, and you acknowledge that it is fair and reasonable for you to be bound by this agreement.
8.2 For business purchases, to the maximum extent permitted by law, this Warranty is the only warranty given by TTS and all other warranties, conditions and guarantees (whether express or implied by statute, including those implied by the Contract and Commercial Law Act 2017, or otherwise) are excluded.
8.3 This section 8 only applies where you have indicated on the Registration & Acknowledgement Form (or on your invoice or other written agreement with us) that the Trailer is acquired for business purposes.
9. YOUR RIGHTS UNDER THE CONSUMER GUARANTEES ACT 1993 (CONSUMERS)
9.1 If you are a consumer (you acquired the Trailer for personal, domestic or household use), our goods come with guarantees that cannot be excluded under the Consumer Guarantees Act 1993. This Warranty is in addition to, and does not replace or limit, your rights under the CGA and the Fair Trading Act 1986. Any exclusion, condition or limitation in this Warranty applies only to the extent permitted by law and does not affect your statutory rights.
9.2 Under the CGA, the Trailer must be of acceptable quality (including being durable, safe and free from minor defects for as long as a reasonable consumer would expect), fit for any particular purpose you made known to us, match its description, and match any sample or demonstration model.
9.3 The CGA guarantee of acceptable quality does not apply to a fault caused by the Trailer being used in a manner, or to an extent, that is inconsistent with what a reasonable consumer would expect (for example overloading, misuse or failure to follow our maintenance instructions), or to defects you were told about before you bought it.
9.4 If the Trailer does not meet a guarantee: where the failure can be fixed and is not serious, we may choose to repair it, replace it or refund the price within a reasonable time. Where the failure is serious, or cannot be fixed or is not fixed within a reasonable time, you may choose to reject the Trailer and receive a refund or replacement, or keep it and claim compensation for the reduction in its value. You may also be entitled to compensation for reasonably foreseeable loss or damage caused by the failure.
9.5 You must contact us first and give us a reasonable opportunity to fix a problem. If you have repairs done elsewhere without first giving us that opportunity, we may not have to cover the cost. If you wish to reject the Trailer for a serious failure, you must do so within a reasonable time.
9.6 For more information, see www.consumerprotection.govt.nz.
10. PRIVACY AND GENERAL
10.1 We collect the personal information on the Registration & Acknowledgement Form to register and administer your warranty, contact you about service reminders and product safety recalls, and assess claims. It is held by TTS at the address above. Under the Privacy Act 2020 you may ask to access and correct your personal information by contacting us.
10.2 This Warranty is governed by New Zealand law. If any part of it is found to be unenforceable, that part will be read down or removed and the rest will continue to apply.
CARE & MAINTENANCE GUIDE
Regular maintenance is a condition of your warranty (see clauses 3.1(d) and 4.1(e)–(f)). Our environment is corrosive and harsh on metal – prevention is better than cure.
Maintenance checklist
- Wheel nuts and U-bolts: must be re-torqued (tightened) within the first 100 km after collection – this applies to new Trailers and after any repair. Check that wheel nuts are tight again after 2 weeks or 100 km.
- Wheel bearings: check and adjust 2 months after purchase and every 6 months after that. Re-pack with suitable grease as required.
- Lights: check that all lights work before every trip (check plugs and wiring).
- Fasteners: check coupling bolts, U-bolts, shackle bolts and bushes.
- Greasing: grease all grease points on tandem and/or braked trailers (coupling and rocker suspension).
- Brakes: lubricate brake calliper slides to ensure smooth and effective braking.
- Annual service: have the Trailer serviced at least every 12 months by TTS (or, outside Auckland, a reputable trailer service provider) and keep the invoice.
Loading and towing
- Never exceed the Trailer's GVM (tare weight of the empty Trailer plus payload). The GVM quoted is for normal road use. If your Trailer has a cage and/or spare wheel, add their weight to the tare weight. Overloading will void all warranties.
- Know your tow vehicle's towing and tow-ball capacity and stay within its limits as well as the Trailer's.
- Load with the bulk of the weight over the axle(s) and keep the load as low on the deck as practical.
- Boat trailers must be fitted to the individual boat to ensure correct hull support and a tow-ball download of approximately 10% of the GVM. Failure to do so can damage the Trailer, vehicle or vessel and, in extreme cases, make the Trailer dangerous to tow.
Cleaning and corrosion prevention
- Where possible, cover the Trailer or store it under cover when not in use.
- Do not leave refuse in box trailers. Clean the Trailer after use, particularly inside.
- Always wash the Trailer down after carrying acidic or alkaline materials, including grass clippings and fertiliser.
- If you use the Trailer in or near salt water, corrosive chemicals or materials, wash it down thoroughly with fresh water after every use.
Brakes
- If your Trailer has brakes, do not store it with the brakes on. Allow the brakes and hubs to cool after towing before immersing them in water.
- Brakes must be serviced in line with the brake manufacturer's guidelines to keep their warranty.
Jockey wheel
- The jockey wheel is designed to move an empty Trailer short distances. Moving a loaded Trailer on the jockey wheel, or putting excessive weight on it, can damage it. If a heavy load must be supported, replace the jockey wheel with a heavy-duty machinery stand.
Trailer cage
- Trailer cages are designed to contain loads. They are not suitable for carrying loads across the cage ends – carry pipe, timber and similar loads on purpose-built H-frames.
Tyre pressures
- Keep tyres correctly inflated for the load: standard pressure is currently 40 psi; for heavy loads increase to 50 psi. Never exceed the maximum pressure shown on the tyre sidewall.
